Andy Sanborn, the owner of the Concord Casino who is facing felony theft charges, is appealing the revocation of his gaming license by arguing it was “unreasonable and unlawful.”

Sanborn filed an appeal asking a Merrimack County Superior Court judge to reverse administrative Judge Gregory Albert’s order, which had called the pending issues between Sanborn and the New Hampshire Lottery Commission regarding the sale of the Concord Casino “moot,” because Sanborn’s licenses had expired. Albert also said some aspects of the case were “not ripe for review” given the unresolved criminal charges against Sanborn and his company.

Sanborn argues those judgments were false and that the ruling is contradictory: His legal petitions cannot be both too early and too late, he said in the court filing. He’s still trying to sell Win Win Win, LLC, the company that ran the shuttered Concord Casino. That business’s value, he argues, will be affected by his current court proceedings.

He also accuses the Lottery Commission and Attorney General’s Office of trying to kill a sale of the casino. 

“Respondents attempted to intimidate buyers (e.g., by suggesting buyers would face criminal liability for conduct alleged to have been undertaken by Petitioners before the sale), undermine the possibility of a sale, and cause delays to run out the clock on the revocation deadline,” Sanborn’s appeal states.

The fights over Sanborn’s gambling license, and the sale of Concord Casino, have been tied up in court for over a year. Sanborn has argued that without his gaming license, the casino becomes virtually worthless to potential buyers. Sanborn, a former state senator, is involved in multiple lawsuits regarding his casino and the criminal charges against him.
